INITIATION (SUNSET REVIEW NOTIFICATION)

New Delhi, the 15th March, 2000.

Subject:- Initiation of Sunset review for the continuance of anti-dumping duty imposed on 3, 4, 5 Trimethoxy Benzaldehyde originating in or exported from China PR.

No. 17/1/2000-DGAD :- The Designated Authority having regard to the Customs Tariff Act, 1975 and the Customs Tariff (Identification, Assessment and Collection of Duty or Additional Duty on Dumped Articles and for Determination of Injury) Rules, 1995 thereof recommended imposition of definitive Anti Dumping duty on imports of 3, 4, 5 Trimethoxy Benzaldehyde originating in or exported from China PR falling under Chapter 29 of the Customs Tariff Act, 1975 vide Gazette Notification No. 9/10/94-TPD dated 31-1-95. The Government of India imposed anti-dumping duty vide notification No. 75 dated 20-03-1995.

1. Product under consideration:- The product under consideration is 3, 4 ,5 Trimethoxy Benzaldehyde, classified under heading 2912 Schedule I of the Indian Customs Tariff Act, 1975. The classification is, however, indicative and is not binding on the scope of the present review.

2. Initiation:- The Customs Tariff Act, 1975 and the rules made thereunder require the Authority to review, from time to time, the need for the continuance of Anti Dumping duty. The Designated Authority issued public notice vide notification no.38/1/97-ADD dated 12/05/98 for initiation of review for the continuance of anti dumping duty imposed on 3, 4, 5 Tri Methoxy Benzaldehyde originating in or exported from China PR and considered appropriate to continue the imposition of anti dumping duty vide notification no. 38/1/97-ADD dated 8.3.99. The Designated Authority, therefore, considers that the sunset review of the Anti Dumping duty recommended vide Notification dated 31.1.95 referred above, would be appropriate at this stage. In the mean time M/s. Alpha Drug Ltd., Patiala, Punjab also submitted a representation for continuance of anti dumping duty on 3,4, 5 Tri Methoxy Benzaldehyde originating in or exported from China PR for further period of five years.

3. Procedure:- Having decided to review the findings arrived in the notification dated 31.1.95, the Authority is hereby initiates investigations to review (Sunset review) the need for continuance or otherwise of duty recommended on imports originating in or exported from China PR in accordance with the Customs Tariff (Amendment) Act, 1995 and The Customs Tariff (Identification, Assessment and Collection of Anti-Dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995.

4. The review covers all aspects of notification No. 9/10/94-TPD dated 31.1.95 and subsequent review initiation notification No. 38/1/97-ADD dated 8.03.95.

5. Period of Investigation:- The period of investigation for the purpose of the present review is 1st Jan., 1999 to 31st December, 1999.

6. M/s. Alpha Drug India Ltd. was considered as the domestic industry in the notification referred to above. The Designated Authority (hereinafter referred to as Authority) proposes to consider M/s. Alpha Drugs Ltd., P.O. Lalru, Distt. Patiala, Punjab as domestic industry in accordance with the Rules supra

7. Submission of Information:- The exporters in the subject countries, the importers in India known to be concerned and the domestic industry are being addressed separately to submit relevant information in the form and manner prescribed and to make their views known to the

Any other interested party may also make its submissions relevant to the investigation in the prescribed form and manner within the time limit set out below.

8. Time Limit:- Any information relating to this review and any request for hearing should be send in writing so as the reach the Authority at the above address not later than forty days from the date of publication of this review notification. If no information is received within the prescribed time limit or the information received is incomplete, the designated Authority may record its findings on the basis of the facts available on record in accordance with the Rules supra.

9. Inspection of Public File:- In terms of rule 6(7), any interested party may inspect the public file containing non-confidential version of the evidence submitted by other interested parties.
