INITIATION NOTIFICATION
New Delhi, the 13th September, 1996
Subject : Initiation of anti-dumping investigations concerning import of Acrylic Fibre from USA, Thailand and Republic of Korea.
No. 47/ADD/IW.-M/s. Indian Acrylic Ltd. and M/s. Pasupati Acrylon Ltd. have jointly filed a petition in accordance with the Customs Tariff (Amendment) Act, 1995 and Customs Tariff’(Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995 before the Designated Authority alleging dumping of Acrylic Fibres from the United States of America (USA), Thailand and the Republic of Korea (Korea RP) and requested for anti-dumping investigation and levy of anti-dumping duty.
2. Domestic Industry :-The petition has been filed by M/s. Indian Acrylic Ltd., 610-61 1, 6th Floor, Chiranjiv Towers, 43, Nehru Place, New Delhi and M/s. Pasupati Acrylon Ltd., M-14, Connaught Circus, Middle Circle, New Delhi. The petition is supported by the Forum of Acrylic Fibre Manufacturer and also individually by M/s. J. K. Synthetics Ltd. and M/s_ Consolidated Fibre and Chemical Ltd. The petitioners account for approx. 37 per cent of total Indian production: and the petition is supported by those producers whose collective output constitutes more than fifty per cent of the total domestic production. The petitioners, therefore, account for majority production in India and have a standing to file a written request on behalf of domestic industry under the rules aforesaid.
3. Product Involved :-The product involved is Acrylic Fibre, both in shrinkable and non-shrinkable form. Acrylic Fibre is a long chain of synthetic polymer composed of at least 85 per cent by weight of Acrylonitrile units. The range of Acrylic Fibre is stated to be from 1.5 Denier to 8.0 Denier. Acrylic Fibre has application in day to day life use apparel, and some industrial uses.
4. Acrylic Fibre is classified under custom code-550330 of Customs Tariff Act. The classification is, however, indicative only and is in no way binding on the present investigations.
Dumping
5. Normal Value :-The petitioners have provided evidence showing domestic prices in USA, based on the information published in a leading Magazine, Petrochemical Consultants International. The Normal Value in case of Thailand has been claimed on the basis of offer made for sale in the domestic market. The petitioners have requested to consider constructed value of Korea RP, though it has furnished evidence showing. domestic price in Korea RP. There is sufficient evidence with regard to the Normal Value prevailing in the domestic markets of the said countries.
6. Export Price : The petitioners have worked out export price as per statistics published by the Directorate of Commercial Intelligence and Statistics, Calcutta, which is found reliable for the purpose of initiation.
7. The petitioners have claimed adjustments for Ocean Freight, Marine Insurance, Customs Clearance and Port Handling, Local Transportation in the countries of export, and Special Packaging for working out ex-works Export Price.
8. On the basis of the information available, there is prima facie evidence that export price to India has been lower than the normal value in the said countries for all the Acrylic Fibres, and, therefore, are being dumped by the exporters from USA, Thailand and Korea RP.
9. Injury :-The various parameters relating to injury such as quantum of imports in absolute terms, market share, import price from the alleged countries and various indicators affecting domestic industry such as production, sales, selling prices, stocks, profit and loss, collectively and cumulatively prima facie indicate that the domestic industry has suffered material injury.
10. There is prima facie evidence that imports of Acrylic Fibre originating from the said countries are causing material injury to the domestic industry.
11. Initiation of Anti-dumping Investigation :-The Designated Authority, therefore, initiates anti-dumping investigation into the existence, degree and effect of alleged dumping of Acrylic Fibre originating in or exported from USA, Thailand and Korea RP.
12. The period of investigation for the purpose of present investigations is April, 1995 to September, 1995.
13. Submission of information :-The exporters in USA, Thailand, and Korea RP and importers in India known to be concerned are being addressed separately to submit relevant information and make their views known in the form and manner described to Shri T. S. Vijayaraghavan, Designated Authority, Ministry of Commerce, Room No. 134-A, Udyog Bhavan, New Delhi -110011.
14. Any other interested party may also make its submissions relevant to the investigation in the prescribed form and manner within the time limit set out above.
15. Time Limit :-Any information relating to the present investigation should be sent in writing so as to reach the Designated Authority at the address mentioned above not later than forty days from the date of publication of this notification. The known exporters and importers, who are being addressed separately, are, however, required to submit the information within forty days from the date of letter addressed to them separately.
16. Anti-dumping investigations being a time bound exercise, the Designated Authority may record its findings on the basis of facts available on record in accordance with the Rules supra, if no response is received within the time stipulated or the information is incomplete in any respect.
