Bilateral Agreement with China

Negotiations for the Accession of the People’s Republic of China to the World Trade Organization in terms of Article XII of the Agreement Establishing the World Trade Organization, in partial fulfillment of the requirements for the People’s Republic of China to accede to the World Trade Organization

The Government of the People’s Republic of China and the Government of the Republic of India hereby inform the Director-General of the World Trade Organization that they have concluded their bilateral market access negotiations in the context of the accession of the People’s Republic of China to the WTO.

They accordingly attach hereto the original of the list of concessions on goods which the People’s Republic of China grants to the Republic of India (Appendix I) in accordance with the implementation period set out therein and the Memorandum of Understanding Between the People’s Republic of China and the Republic of India on China’s Accession to the WTO (Appendix II).

The people’s Republic of China also grants to the Republic of India Initial Negotiating Rights for goods negotiated with the Republic of India as identified in Column 6 of Appendix I at the rate which the People’s Republic of China binds in its Schedule.

The People’s Republic of China shall ensure that the bound rates of duties on accession shall be, at any time, no less favorable than that agreed on February 22,2000.
